  1. General

This policy describes how Mon Agence processes personal data concerning you and what your rights are in the event of the processing of your personal data by Mon Agence.

To accomplish its legal missions, My Agency is required to process your personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 relating to the protection of natural persons at the regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

My Agency ensures that it processes your personal data in an adequate, relevant and limited manner to what is necessary with regard to the purposes for which they are collected.

2. Data Security and Privacy

My Agency takes the necessary steps to guarantee the security of your personal data. It ensures that your data is protected in particular against unauthorized access, illegitimate use, loss or unauthorized modifications. My Agency has implemented technical and organizational measures to guarantee the security and confidentiality of your personal data.

My agency has, among other things, set up an access authorization mechanism (Identity and Access Management) for its agents. This system is designed in such a way that the personal data processed and the processing concerning them are only accessible to persons and applications explicitly authorized on the basis of functional needs.

3. What is personal data?

Within the meaning of Article 4, 1° of the General Data Protection Regulation (GDPR), personal data is “any information relating to an identified or identifiable natural person (hereinafter referred to as concerned person) ; is deemed to be “an identifiable natural person” a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to his physical, physiological, genetic, psychic, economic, cultural or social identity”.

4. Who is the data controller and data protection officer?

My Agency, located Rue de Gomzé, 32/05 at 4140 Gomzé-Andoumont and represented by Mrs. Fabienne De Backer, is responsible for processing the personal data it processes in the context of the performance of its legal missions. This implies that it determines, alone or jointly with others, the purposes and means of processing this personal data.

The data protection officer is Mrs. Fabienne de Backer. The Data Protection Officer is the contact person for all questions relating to the processing of your personal data and the exercise of your rights conferred by the General Data Protection Regulation.

6. What personal data is processed by My Agency and for what purposes are they processed?

The categories of personal data processed by Mon Agence include the following:

identification data (e.g. surname, first name);

contact data (e.g. e-mail address, telephone number).

My Agency collects this personal data, in particular by means of contact forms.

My Agency processes your personal data in order to carry out its contractual missions. Your personal data may not be used by Mon Agence for any purpose other than the performance of its contractual missions.

The processing of this personal data is carried out by Mon Agence in particular for the following purposes:

MANAGEMENT OF YOUR SERVICE REQUEST

Purpose – The data that you transmit to us are obviously processed in order to carry out our contractual mission and in order to communicate with you on this subject.

Categories of data – This may be your surname, first name, image, profession, name of your domicile or residence company, establishment, telephone and fax number, e-mail address, bank account number, identifiers, correspondence, etc.

Indispensable – All this data is essential to the execution of the mission that you entrust to us. Without them, we cannot carry out our mission.

Recipients of the data – Their communication to the employees of My Agency may be necessary for the execution of our mission.

Duration – The data you entrust to us are kept for 5 years after the completion of the last mission you entrusted to us.

QUOTE REQUEST

Purpose – The data that you transmit to us for the preparation of an estimate is processed with a view to producing the most accurate estimate possible according to your needs, your budget and your time preferences.

Data categories – This can be your first and last name, company name, email address, phone number, zip code, city as well as your company name, needs, budget and desired completion times.

Recipient of the data – The data that you provide to us on the quote form are intended to be transmitted to the employees of My Agency.

Duration – The data you entrust to us in your quote request are kept for 1 year after the quote is sent, unless you enter into a contractual relationship with our company.

CONTACT FORM

Purpose – If you wish to send us an idea, comment or question, you can do so via the contact form available on our website. Your contact data will be used exclusively to allow us to contact you further to your request.

Data categories – This can be your first and last name, email, company name, phone number, city and postcode.

Duration – The data that you entrust to us via the contact form are kept for 1 year after the quote has been sent, unless you enter into a contractual relationship with our company.

Your personal data held by Mon Agence may be processed in the context of a telephone conversation with you.

My Agency may, in compliance with the General Data Protection Regulations, Article 4 of the Law of 3 August 2012 and the Royal Decree of 27 March 2015, subsequently process for the performance of another mission legal any personal data collected legitimately in the context of the performance of one of its other legal missions.

Your personal data will never be processed by Mon Agence for commercial or advertising purposes or transferred to third parties who would use this data for such purposes.

7. Who are the recipients of your personal data?

As part of the performance of its legal missions, Mon Agence may receive or communicate your personal data, in particular to the following recipients:

8. Transfers to a third country or an international organization

In compliance with Belgium’s international obligations and in accordance with the regulations in force, My Agency is, for example, required to communicate to the tax authorities of the States concerned tax information, including personal data.

9. Retention of your personal data
Your personal data is not kept longer than necessary for the purposes for which it is processed. The retention period may not exceed the limitation period for offenses that fall within the jurisdiction of My Agency and the complete extinction of all administrative and judicial remedies relating thereto.

What are your rights on the personal data processed by My Agency?

You have a number of rights in relation to your personal data. Some of these rights apply only in limited cases.

* You have the right to access your personal data processed by Mon Agence.

* You have the right to obtain, as soon as possible, the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to obtain the completion of incomplete personal data concerning you.

* You have the right, in certain cases provided for by the General Data Protection Regulation, to obtain the limitation of the processing of your personal data.

* You have the right, in certain cases provided for by the General Data Protection Regulations, to object at any time, for reasons relating to your particular situation, to the processing of personal data concerning you.

* You have the right not to be the subject of a decision based exclusively on automated processing, including profiling, producing legal effects concerning or affecting you, except where this decision is necessary for the conclusion or the performance of a contract, is legally permitted or is based on your consent.

* You have the right, in certain cases provided for by the General Data Protection Regulations, to obtain the erasure of your personal data as soon as possible.

In certain circumstances, the exercise of your rights may be suspended. This is particularly the case for the processing of personal data managed by Mon Agence during the period in which the person concerned is the subject of a check, an investigation or acts preparatory to these carried out by My Agency within the framework of the execution of its legal missions.

10. How can you exercise your rights?
When you find that some of your personal data is incorrect or incomplete or if you wish to exercise your rights, you can submit your request:

Please attach a copy of your identity card to your request.
Your request will be processed within 30 calendar days. If it is complex or the service is faced with a large number of requests, this period will be extended by 60 days.

11 Remedies

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with the Data Protection Authority and to file a judicial remedy if you consider that your rights have not been respected or that a processing of personal data about you is a breach of the General Data Protection Regulation.
